SOP 50 10 8.1 changes the rules for refinancing existing business debt with SBA 7(a) proceeds. The new requirements are consolidated in Appendix 14 and affect delegated authority, qualifying debt, payment history and transaction structure.
One of the most significant changes involves Same Institution Debt. Effective October 1, qualifying SID may be processed under PLP authority. The new SOP also provides a path for refinancing certain debt that originated as a merchant cash advance and increases the seasoning period for seller-financed acquisition debt.
These changes create new underwriting and documentation questions for lenders evaluating refinance requests. Michael Bland will lead a working review of the new rules, focusing on how lenders determine eligibility, structure the transaction, document the credit decision and determine when delegated authority may be used.
