SBA issued SOP 50 10 8.1 on August 14. For loans receiving an SBA loan number on or after October 1, lenders will operate under a substantially reorganized framework.

Experienced SBA lenders already have established processes for underwriting, documenting, approving, and closing loans. The challenge with a new SOP is determining precisely where those existing processes need to change.

That is the focus of this August 27 webinar.

Lance Sexton will conduct a lender-focused working review of SOP 50 10 8.1, examining the changes from the standpoint of the bankers, underwriters, processors, and closers who must apply the new requirements to actual SBA transactions.

One of the most significant changes involves change-of-ownership transactions. SBA now separates these loans into four categories: Initial Acquisition, Business Expansion, Owner Buyout, and ESOP/Co-Op. Each has its own credit considerations, consolidated in the new Appendix 15.

The SOP also introduces a Quality of Earnings requirement for certain acquisition transactions, affecting both the underwriting process and the documentation lenders must obtain before completing their analysis.

SBA has reorganized other major requirements as well. Seven new appendices now address areas that lenders routinely work with, including debt refinancing, change of ownership, guaranty amounts, loan maturity, interest rates, collateral, and submission of the application for guaranty.

The webinar will also examine lenders’ new ability to refinance their own debt using delegated authority, revised guaranty requirements involving Trust-owned borrowers, SBA Express amortization and reissuance provisions, and changes affecting secondary market transactions.

  • The October 1 implementation date and its application to loans currently moving through the pipeline
  • The seven new appendices and how SBA has reorganized key requirements
  • The four new change-of-ownership categories and their underwriting structure, plus the new Quality of Earnings requirement.
