By late October, many SBA lenders have already made repeated requests for year-end financial statements, personal financial statements and tax returns. Some borrowers still have not provided them, but the lender’s servicing responsibility continues.

SOP 50 57 4 provides SBA lenders with alternative ways to monitor a borrower’s financial and operating condition when required financial information is not available. For the servicing team, the questions are what information can substitute for missing financials, when borrower contact should escalate, and what documentation should go in the loan file.

SOP 50 10 8.1 became effective October 1 for loan origination, while servicing and liquidation remain governed by SOP 50 57 4. This session focuses on what that means for lenders managing existing 7(a) loans.

On October 21, Lance Sexton will lead a working session on 10 actions SBA lenders can take when a borrower fails to provide required financial information.
