Effective April 5th SBA lenders will need to access and complete Form 159 within the Capital Access platform.

  1. Why is the submission process for Form 159 changing?
  2. How do I access Form 159?
  3. What if I do not have a CAFS account?
  4. Are there any policy changes to the 159 policy?
  5. Should I enter Form 159 in Etran?
  6. What do I do if the “New Agent” button does not appear
  7. Am I required to submit supporting documentation?

SBA Form 159 is the required disclosure form that borrowers and lenders must complete to report any fees paid to third party agents.

And there are plenty of rules to follow for SBA compliance.

Specifically; significant changes collection of documentation of lender fees implemented last year.

The problem is the wording offers little guidance about loan packaging and referral fees, “The representations of services rendered and the amounts charged as identified in this form are reasonable and satisfactory to it.”

But, SBA does say penalties for noncompliance are stiff. Borrower refunds and SBA guaranty repairs are threatened. And, of course, buried in the regs is the catchall warning, “Violation of any of the SBA loan Program Requirements regarding SBA Form 159 . . .may result in SBA’s suspension or revocation of the privilege of conducting business with the SBA.”

This Coleman webinar will put everything into context, what’s important, and what’s not, and give you a best-practice guide to make sure you are in compliance with the new SBA regulations for SBA Form 159 — “Fee Disclosure and Compensation Agreement.”
